How much can a landlord increase rent, and how often?

In short

India has no general statutory cap on how much rent may rise. For most tenancies the agreement governs, and if it contains no escalation clause there is usually no right to increase rent during the term at all. Where legislation on Model Tenancy Act lines applies, escalation must be quantified in the agreement and revision requires three months' prior written notice. Where an old rent control Act applies, rent is confined to the standard rent and the increases that Act permits.

The question has three different answers

People ask how much a landlord can raise the rent as though there were a national percentage. There is not. What governs is the regime the tenancy falls under, and the three regimes give genuinely different answers.

For most tenancies today the agreement is the whole of it. Where state legislation on the Model Tenancy Act lines applies, the statute adds requirements on top of the agreement. Where an old rent control Act covers the premises, the Act displaces the agreement on rent altogether.

What each regime allows

An agreement cannot contract out of a rent control Act that covers the premises. Where the Act applies, a clause allowing a larger increase does not make it lawful.

The point most tenants miss, and most landlords assume

If your agreement contains no escalation clause, a landlord generally has no right to increase the rent during the term. The rent is a term of the contract, and one party cannot unilaterally vary a contract term because costs have risen or the market has moved.

What a landlord can do is propose an increase on renewal, which is why the 11-month convention suits landlords in a rising market: the tenancy ends and a new rent is negotiated. That is a negotiation, not an increase, and the tenant is free to decline and leave.

So the practical advice differs by side. A landlord who wants predictable escalation should put a quantified clause in the agreement rather than relying on being able to raise it later. A tenant presented with a mid-term increase should read the agreement before paying it, because quite often there is no clause supporting it.

Improvements, and when they justify more rent

A genuine distinction runs through all three regimes between maintaining a property and improving it. Repairs that keep the premises in the condition they were let in are the landlord's ordinary obligation and do not create a right to charge more.

Structural alterations or improvements are treated differently. Under the Model Tenancy Act, where the landlord carries out additional structural alterations or improvements, which does not include necessary repairs, the rent may be increased one month after the work is completed, by an amount agreed between the parties.

The phrase to notice is by an amount agreed. The improvement creates the occasion for an increase; it does not let the landlord set the figure unilaterally.

If you are given a rent increase

Same sequence for a tenant whether the increase turns out to be valid or not.

  • Read the agreement for an escalation clause and a lock-in period before responding to anything.
  • Establish which regime governs: an old rent control Act, state legislation on Model Tenancy Act lines, or neither.
  • Check the notice. Where the Model Tenancy Act applies that is three months in writing, and an increase inside the term with no quantified clause is generally not claimable.
  • Reply in writing either way, accepting or disputing, rather than staying silent.
  • If you dispute it and the Model Tenancy Act applies, the Rent Authority adjudicates revision disputes, and rent can be deposited there if the landlord refuses to accept it.
  • Keep paying the undisputed amount. Withholding rent entirely converts a dispute about an increase into a default, which is a much worse position.

Rent increase FAQ

How much can a landlord increase rent in India?

There is no national cap. For most tenancies the escalation clause in the agreement governs, and with no such clause there is generally no right to increase during the term. Under legislation on Model Tenancy Act lines the escalation must be quantified in the agreement, and under an old rent control Act rent is confined to the standard rent plus the increase the Act permits.

Can a landlord increase rent in the middle of a tenancy?

Generally not, unless the agreement provides for it. Rent is a contractual term and one party cannot vary it unilaterally. A landlord can propose a new rent on renewal, which the tenant is free to accept or decline, but that is a negotiation rather than an increase.

How much notice is required for a rent increase?

Where legislation on Model Tenancy Act lines applies, three months' prior written notice. Otherwise it is whatever the agreement specifies, and where an old rent control Act covers the premises, what that Act provides.

Is there a 10 percent annual rent increase rule in India?

No. Ten percent is a market convention that appears in many agreements, not a statutory figure, and nothing requires a tenant to accept it where the agreement does not provide for it. Some rent control Acts do set a permitted annual increase, but those figures are specific to those Acts and apply only to covered tenancies.

Can rent be increased after the landlord renovates?

Under the Model Tenancy Act, where the landlord carries out structural alterations or improvements, as distinct from necessary repairs, the rent may be increased one month after completion by an amount agreed between the parties. Ordinary repairs that maintain the property do not create a right to charge more.

What if I ignore a rent revision notice?

Do not. Under the Model Tenancy Act a tenant who does not respond to a revision notice may be treated as having accepted the increase. Reply in writing within the notice period, disputing it if you disagree, because silence can be read as agreement.
