Tenant rights under the Model Tenancy Act
The Model Tenancy Act, 2021 gives tenants a security deposit capped at two months' rent for residential premises, 24 hours' notice before the landlord enters, protection against essential supplies being withheld, a defined split of repair obligations with a self-help remedy if the landlord does not act, and rent revision only on three months' written notice. It also gives landlords defined eviction grounds and a faster forum. All of it depends on your state having enacted legislation on its lines.
What it is trying to fix
Old rent control legislation protected sitting tenants so effectively that landlords stopped letting, which contributed to vacant housing stock alongside a shortage of rental supply. The Model Tenancy Act is an attempt to rebalance: tenants get defined protections written into statute rather than left to the agreement, and landlords get certainty about rent, deposits and a quicker route to possession.
That dual purpose is the reason it reads differently from a rent control Act. It does not fix rent. It regulates the relationship and provides a forum.
What a tenant gets
| Right | What the model provides |
|---|---|
| A capped security deposit | Not more than two months' rent for residential premises, and not more than six months' for non-residential |
| Deposit returned on exit | Refunded at the time the landlord takes over vacant possession, after due deductions |
| Notice before the landlord enters | At least 24 hours' notice, for repairs, inspection or another reasonable cause set out in the agreement. Emergencies such as fire, flood or earthquake are excepted |
| Essential supplies cannot be cut | The landlord is prohibited from withholding any essential supply or service to the premises |
| Repairs actually get done | Structural repairs, whitewashing, painting of doors and windows, plumbing and wiring sit with the landlord; if essential repairs are not carried out within 30 days the tenant may do them and deduct the cost from rent against bills |
| Rent cannot jump mid-tenancy | Revision requires three months' prior written notice, and escalation must be quantified in the agreement or it cannot be claimed during the tenancy |
| A forum that is not a civil court | A Rent Authority for disputes, with rent depositable there if the landlord refuses to accept it |
The repair remedy is the unusual one
Most of these protections restate what a well-drafted agreement would contain anyway. The repair provision goes further, because it gives the tenant something to do when the landlord simply does not respond.
Where essential repairs that are the landlord's responsibility are not carried out within thirty days, the tenant may have the work done and deduct the cost from the rent, supported by the bills. That converts a complaint into a remedy the tenant can exercise alone, which is the single most practically useful thing in the model for a tenant dealing with an unresponsive landlord.
The limits matter. It applies to repairs that are the landlord's obligation and that are essential, the bills have to be produced, and a tenant who uses it as a route to general improvements will be on weak ground.
What the landlord gets
It is not a tenant-protection statute dressed up as a balanced one. The landlord gets a defined list of eviction grounds including failure to pay rent for two consecutive months, a Rent Authority and Rent Court intended to move faster than ordinary civil litigation, and a deterrent against overstaying: a tenant who does not vacate after the tenancy has ended or been terminated becomes liable to pay double the monthly rent for the first two months and four times the monthly rent thereafter.
That escalating compensation is the provision landlords most often do not know about, and it is the counterweight to the protections on the tenant's side.

Model Tenancy Act FAQ
What rights does a tenant have under the Model Tenancy Act?
A security deposit capped at two months' rent for residential premises and refunded on handover, at least 24 hours' notice before the landlord enters, protection against essential supplies being withheld, landlord responsibility for structural repairs with a self-help remedy after 30 days, rent revision only on three months' written notice, and access to a Rent Authority for disputes.
Does the Model Tenancy Act apply across India?
No. It is a template circulated to the states rather than a central law, and it binds only where a state has enacted legislation on its lines. Assam, Uttar Pradesh and Andhra Pradesh have done so, and Tamil Nadu legislated earlier in 2017 on an earlier draft. Elsewhere it is not your law.
How much notice must a landlord give before entering?
At least 24 hours, for carrying out repairs, inspecting the premises or another reasonable cause specified in the agreement. Entry without notice is permitted only in emergencies such as fire, flood, earthquake or similar calamity.
Can a tenant get repairs done and deduct the cost?
Under the model, yes, in defined circumstances. Where essential repairs that are the landlord's responsibility are not carried out within 30 days, the tenant may have the work done and deduct the cost from rent, supported by the bills. It covers the landlord's own obligations and essential work, not general improvements.
Can the landlord increase rent during the tenancy?
Only in the manner the model provides. Escalation has to be quantified in the tenancy agreement, failing which an increase cannot be claimed during the tenancy, and any revision requires three months' prior written notice. Separately, rent may be increased a month after structural improvements are completed, by an amount agreed between the parties.
What happens if a tenant does not vacate after the tenancy ends?
The model makes the tenant liable to pay double the monthly rent for the first two months and four times the monthly rent thereafter, for as long as the premises remain occupied. It is the main deterrent against overstaying and the provision landlords are least likely to know about.
Can I use these terms if my state has not adopted the Act?
Yes, as contract. A deposit cap, an entry-notice requirement, a repair timetable and a rent revision notice period can all be written into an ordinary rent agreement. They bind as terms between the parties rather than as statute, which is weaker in some respects but still enforceable.
